Practice Area
Attorney-managed escrow accounts protecting buyers and sellers throughout every Belize real estate transaction.
Important: No Title Insurance is recommended in Belize
Attorney-managed escrow is the primary mechanism for protecting buyers and sellers in real estate transactions. Using a licensed attorney as your escrow agent is not just best practice — it is essential to a safe transaction.
What We Offer
Eduardo B. Aguilar & Associates provides professional escrow services for real estate transactions throughout Belize. As a licensed attorney and notary public, Eduardo B. Aguilar holds all escrow funds in a dedicated attorney trust account — fully separate from firm operating accounts and in strict compliance with Belizean law.
Whether you are a foreign buyer purchasing a beachfront condo on Ambergris Caye or a local investor closing a commercial deal, our escrow service gives both parties the confidence to proceed — knowing that funds are protected until every condition is met.
The Process
Buyer and seller sign a purchase agreement. Escrow instructions are prepared and agreed upon by all parties.
The buyer deposits the agreed escrow amount into our attorney trust account. Funds are held securely and separately from firm operating accounts.
Title searches, surveys, and all required due diligence are completed. Any conditions in the agreement must be satisfied before funds are released.
Once all conditions are met and the transfer is complete, funds are disbursed to the seller and all closing costs are settled from escrow.
Why Use Attorney Escrow
Your funds are never released to the seller until all contractual conditions are fully satisfied — title is clear, documents are signed, and the transfer is complete.
Sellers have confidence that a qualified buyer has committed funds and that payment will be made promptly upon closing.
We provide clear reporting on all escrow activity. Both parties receive confirmation of deposits, conditions, and disbursements.
All escrow accounts are maintained in strict compliance with Belizean law and professional standards governing attorney trust accounts.
Common Questions
Why do I need escrow for a Belize real estate transaction?
Unlike many countries, Belize does not have title insurance. Escrow held by a licensed attorney provides the protection that title insurance would otherwise offer — your funds are safe until the transaction is verified and complete.
Who holds the escrow funds?
Eduardo B. Aguilar & Associates holds all escrow funds in a dedicated attorney trust account, completely separate from firm operating funds. This is a professional and legal requirement.
What happens if the transaction falls through?
If the transaction does not close due to a failed condition (such as a title defect discovered during due diligence), the escrow funds are returned to the buyer in accordance with the terms of the escrow agreement.
Can foreign buyers use your escrow service?
Yes. We regularly provide escrow services for international buyers purchasing property on Ambergris Caye and throughout Belize. We are experienced in the unique needs of foreign investors.
How long does the escrow process take?
The timeline depends on the complexity of the transaction and how quickly due diligence can be completed. A typical residential closing on Ambergris Caye takes 30–60 days from executed agreement to closing.
